Cornyn Denounces Reid

Sen. John Cornyn released a statement this afternoon decrying Majority Leader Reid’s failure to live up to his promise to confirm three circuit nominees before the Memorial Day recess, which begins Saturday. Cornyn notes that Reid could easily have kept his promise – think Matthews, Conrad and Keisler – and warns that there will be repercussions. See here for the full statement and below for an excerpt.
It is inexcusable that the Majority Leader broke his commitment … despite knowing there were long-pending nominees who could be confirmed before the deadline. He had ample opportunity to honor his pledge … I fear that the Majority Leader’s unwillingness to confirm judges will have negative consequences not only for our federal judiciary, but the Senate’s broader agenda.
How many times can you promise something will have consequences before actually following through? How many times? Is cornyn impressed with himself for putting out a press release? Is mcconnell pleased with his floor statements? STOP TALKING AND DO SOMETHING.

the 4th ct struck down the VA pba ban tuesday. even after last year's decision. two Clinton judges. no surprise there.
VA will appeal this to the SC. They know they have the votes to win there. Plus, the SC expressly directed the 4th ct to vacate their prior invalidation and reexamine it in light of Carthart II and they still struck it down again. That's like flipping the bird to the court.
Given that Kennedy voted to uphold the NE Pba in strong terms, he's a reliable vote on this issue. There's 5 votes to reverse the 4th ct. Although, those 2 Clinton judges would probably strike it down a third time if they could.
The case should be heard next term and will be another big conservative victory. I have a feeling it will go somewhat further than last year;s will and will be another rung on Roberts; incremental approach to reversing big decisions.
Fortunately, even if Obama wins, we have our 5 Justices for this case.

The Senate Republicans have to do more than just denounce this. They have to make Reid and the Dems regret their failure to honor their pledge. Real action must be taken.
