in 4 days? Are we giving up? Keeping our powder dry? I've sent about 6 areas of questions asking one of my senators (a Republican on the Judiciary Committee) to delve deeply with the nominee.

I think everyone needs a break after the initial uproar over her nomination (and the weeks of speculation leading up to it), plus there have been holidays, graduations, weddings, typical late May/early June stuff.

But this basic reporting and analysis is that barring something truly unforseen, tho she's not completely out of the woods yet on what we HAVE seen so far, she's going to be confirmed. The Dems have the numbers, and Repub senators barely have enough ability & interest to get a slight handful of their own judges confirmed, never mind stopping somebody else's.

They're fat, lazy, self-obsessed, in most cases have minimal knowledge of the subject, and don't believe half their own rhetoric. Most are terrified of a true debate on judicial philosophy, because most of them are secret social liberals who also secretly believe in the federal nanny state.

Like Curt said, this should be a teaching moment, and practice for either a Koh nomination or a Scalia/Kennedy vacancy. The "wise Latina" & "appellate judges make the law" remarks need to be stated and restated calmly and clearly, without hysteria, dudgeon & umbrage. Dems did that to Alito and it blew up in their faces.

Reiterate the facts of Ricci, and thoroughly explore the conflict of interest charges. But calling her a racist or wailing about nunchucks is pointless. Present the facts, over and over, and let them speak for themselves.

The one thing that must not be done is allowing a fast track. Let's see how SCOTUS rules on Ricci and how the public reacts to it.

And frankly, Soto has Type I diabetes and will probably overall be little different from Souter. She'll be worse on quotas and business, a bit better on law enforcement, and about the same otherwise. Let's educate the public, give Reid & Leahy a few tweaks, and put Barry on notice if he trys to get any further left next time.

Kagan & Garland for RBG & JPS is fine, Karlan & Koh not so much. And it will have to be Callahan or Mahoney at a minimum for Nino or Tony.

Today the Judiciary Committee reported 2 circuit court nominations to the Senate:

* David F. Hamilton, to be United States Circuit Judge for the Seventh Circuit
(12-7; party-line vote)

* Andre M. Davis, to be United States Circuit Judge for the Fourth Circuit
(16-3)

The nomination of Gerard E. Lynch, to be United States Circuit Court Judge for the Second Circuit was held over for a week.

Sonia Sotomayor, US President Barack Obama's nominee for the US Supreme Court, has fractured her ankle.

Ms Sotomayor sustained the injury after tripping at La Guardia airport in New York, while on her way to Washington DC for a series of meetings with senators.

I suppose that John Roberts and Sam Alito, drawing on the richness of their athletic and military experience, would be able to better navigate the treacherous stairs at the airport.

But aside from that breaking report, let me share something new sizzling and startling report to you. One of the big mysteries is whether or not extra terrestrial creatures roaming this planet. Supposedly, the government covered up the arrival of extra terrestrial creatures in Roswell. Rumors of space aliens persist, and recently headlines were seen of Unknown Life Form Found In North Carolina Sewer, due to footage of strange looking organisms found in a sewer pipe. Scientists have all arrived at the conclusion that it's just colonies of worms, likely annelid or tubifex worms covered in slime, which attach themselves to container walls and river bottoms, and are often food for pet tropical fish. Don't get any fast cash or online loans and build a bunker; no extra terrestrial creatures have been found by science - yet.
