Can any readers out there tell me anything about Maryland federal district judge Richard Bennett, in terms of how conservative/textualist/originalist he may or may not be?

scotusblog.com guesses that scalia is likely writing the controlling opinion in the gun case.

secondly on redstate, there was a blog about fred! thompson being the chief judicial vetter for mccain.

that should excite conservatives

Yep .. A Souter or Stevens letter to the White House would trigger a hopefully quick nomination and a hopefully rock solid fight from the Republicans in the US Senate.

tomorrow, for the 1st time in over 200 years, the SC may actually have recognized the 2nd amendment. If this happens, it will be a huge victory and Bush's appointment of Alito will have been the difference.

I just hope that the opinion can get 5 votes. I think it will on the question of individual vs collective right and on whether to strike the DC ban, but I'm not sure about the standard of review.

If Kennedy gives the 5th vote, that would make up for his vote in Boumediene. In the long run, this case is way more important.

I don't know, O'Connor may have been solid on the 2nd Amendment as well. But, Alito and Roberts are still great picks -- far better than anyone Kerry (shudder) would've put on the Court.
